Justice of the Peace Precinct 1Judge Wayne Mack spoke with the club about Praying or not Praying in Government referring to the two year legal battle he has had with a Wisconsin group The Freedom from Religion Foundation for alleging that Judge Mack’s starting every court session with a short prayer is “unconstitutional”. Judge Mack pointed out that both the U.S. Supreme Court and Texas Supreme Court start their opening sessions with an invocation, and he’s “just following in their footsteps.”
Attorney General Ken Paxton has ruled in Judge Mack’s favor that everything he is doings is Constitutional both the Invocation before courtroom session and the Chaplaincy program. Judge Mack even pointed out that there are signs and screens up all over the courtroom stating that it is the Court’s practice to Pray and Pledge allegiance to both the US and Texas flag. They give everyone the option to leave the room or not to be present and the bailiff will notify the person when court is in session. They have never forced someone to pray.
Judge Mack even went on to discuss the Chaplaincy Programwhich is a volunteer program made up of 70 members of various religious and faith backgrounds participating from all local area churches and organizations. The volunteersrotate on a weekly rotating schedule to be available at any time of day or night. Chaplains are called on an as needed basis only! The Chaplains are called to provide comfort to families when the JP’s are trying to determine a cause of death since Montgomery County does not currently have a Medical examiner office (working to have one in the next two to five years). Judge Mack is currently working with three other Texas Counties and others state to establish a Chaplaincy program. Judge Mack concluded with a “thank you for all the support and prayers!”
